The law

What is the POSH Act?

The POSH Act, 2013 (the Sexual Harassment of Women at Workplace (Prevention, Prohibition and Redressal) Act) is India’s law for preventing and redressing sexual harassment at work. Every organisation with 10 or more employees must adopt a policy, constitute an Internal Committee, display notices, train employees and file annual reports.

In the United States the same ground is covered by Title VII of the Civil Rights Act, 1964, enforced by the EEOC, with state laws that mandate training: California, New York, Illinois and Connecticut among them. Different statutes, same duty: a safe, respectful workplace.

Is your organisation truly POSH compliant?

Real compliance is a running system, not a document. If any item below is unclear, there is a gap worth closing before a complaint or inspection finds it.

  • A written anti-harassment / POSH policy adopted and circulated
  • ICC constituted correctly (India) or complaint channels defined (US)
  • Mandatory notices displayed and employees informed
  • Training delivered — and repeated at the required frequency
  • Registers, records and annual filings in order

Why now

Why compliance cannot wait

In India and the US, workplace-harassment compliance is a standing legal duty, not a one-time project.

  1. Mandatory by law

India: 10+ employees triggers a mandatory Internal Committee. US: Title VII applies from 15 employees, with stricter state rules below that.

  2. Delay carries risk

Complaints, penalties, EEOC charges and reputational damage all become harder to manage once an issue is live.

  3. Prevents culture issues

A clear framework surfaces problems early, before they escalate into disputes or attrition.

  4. Awareness is essential

Regular sensitisation is a legal expectation in both countries — and the foundation of a respectful workplace.

  5. Protects everyone

Proper compliance protects management, HR teams and employees alike — on both sides of a complaint.
